By accessing or using Backyard Closures ("Service"), operated by Backyard Weather LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Backyard Closures provides AI-powered school closure predictions based on weather data and historical patterns. The Service includes:

  • Current weather conditions and active school closures (Free tier)
  • 5-day closure predictions with confidence ratings (Paid tiers)
  • Email alerts for predicted closures (SMS coming soon)
  • Commercial API access for businesses and developers

3. Independent Service & No Affiliation

Backyard Closures is an independent service and is not affiliated with, endorsed by, or connected to any school district, educational institution, government agency, or official decision-making body. We are a private company that provides predictive analytics based on publicly available weather data and other information sources.

Our predictions and disruption calculations are generated using real-time weather data, weather models, historical patterns, and other publicly available information. These predictions are informational in nature and do not represent, influence, or constitute official decisions by any school district or educational authority.

4. Accuracy Disclaimer

IMPORTANT: While we strive for accuracy, our predictions are estimates based on available data. We do not guarantee accuracy and are not responsible for:

  • Incorrect predictions or missed closures
  • Decisions made based on our predictions
  • Financial losses or inconveniences
  • Official school district announcements that differ from predictions

For official closure and delay information, always consult your local school district directly.

5. Account Registration

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You must be 18 years or older to create an account
  • One person or entity may not maintain multiple free accounts

6. Subscription and Billing

Pricing

  • 24-Hour Pass: $1.99 (one-time)
  • Premium Monthly: $9.99/month
  • Commercial: Custom pricing

Billing Terms

  • Subscriptions auto-renew monthly unless cancelled
  • 24-Hour Pass expires after 24 hours with no renewal
  • Prices may change with 30 days notice
  • No refunds for partial months or unused time

7. Acceptable Use Policy

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any portion of the Service
  • Scrape, harvest, or extract data through automated means
  • Resell or redistribute predictions without commercial license
  • Overload or disrupt the Service
  • Impersonate others or provide false information

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Backyard Weather LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. API Terms (Commercial Tier)

  • API access requires a commercial subscription
  • Rate limits apply based on your subscription tier
  • API keys must be kept secure and not shared
  • We reserve the right to revoke access for abuse

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKYARD WEATHER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to defend, indemnify, and hold harmless Backyard Weather LLC from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • At our sole discretion for any reason

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Virginia, without regard to its conflict of law provisions. Any legal action must be filed in the courts located in Fairfax County, Virginia.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.
